5. That petitioner, as the surviving husband of said deceased, is advised and believes that he has a prior right to appointment as the Administrator herein and is therefore entitled to letters of administration of said estate.
6. Title 58, O.S. § 128. D., provides that, if the applicant for appointment has a prior right to appointment, then no notice shall be given, and the court shall proceed without delay to hear such petition.
7. Title 58 O.S. §171 provides that the court may, in its judgment, make an order that no bond shall be required if the circumstances indicate none is necessary.
Wherefore, petitioner prays that this petition be heard instanter, without notice, and that upon such hearing, he be appointed as the administrator herein, to serve without the posting of a bond; and that letters of administration be issued to him.
