About the U.S. District Courts

The United States federal court system has three main tiers: the District Courts, which are the trial courts; the Circuit Courts, which are the first levels of appeal; and the Supreme Court of the United States, which is the final level of appeal. There are 94 District Courts, 13 Circuit Courts, and one Supreme Court across the entire country.

The nation’s 94 U.S. District Courts resolve disputes by determining the facts and applying legal principles to determine appropriate outcomes. These District Courts can handle both civil and criminal federal cases. The Districts are the same as those for the U.S. Attorneys. The U.S. Attorney is the main prosecutor for the federal government in their district.

Each state in the U.S. has at least one District Court. The District of Columbia also has a District Court. Each district includes a U.S. Bankruptcy Court as a unit of the District Court. The U.S. territories of Puerto Rico, the Virgin Islands, Guam, and the Northern Mariana Islands also have District Courts that hear bankruptcy cases.

Federal trial courts have also been established with nationwide jurisdiction for special areas, such as tax (United States Tax Court), claims against the federal government (United States Court of Federal Claims), and international trade (United States Court of International Trade).

U.S. District Court Officials

Supreme Court justices, Court of Appeals judges, and District Court judges are nominated by the President and confirmed by the United States Senate, as required by the United States Constitution.

District Court judges are responsible for managing the court and supervising the court’s employees. These judges can serve for life as long as they maintain “good behavior,” and they can be impeached and removed by the United States Congress. Many of the District Courts are led by a Chief District Judge, who is appointed to create the schedule of District Court sessions for the district, assign District Court judges to preside over those sessions, and supervise the magistrates for each county in the district.

Federal Magistrate judges assist District Court judges in preparing cases for trial and may also conduct trials in misdemeanor cases. Magistrates are appointed by the District Court by a majority vote of the judges and serve full-time for a term of eight years or part-time for a term of four years. Federal Magistrate judges can be reappointed after completion of their term.

Each District Court appoints a Clerk of Court, who is responsible for overseeing filings made with the court; maintaining the court's records; processing fees, fines, and restitution; and managing the non-judicial work of the court, including information technology, budget, procurement, human resources, and finances. Clerks may appoint deputies, clerical assistants, and employees to carry out the work of the court. Generally, the Clerk must reside in the district for which they are appointed. However, the Clerk of the District of Columbia and the Clerk of the Southern District of New York may live within twenty miles of their respective districts, if not within the district itself.
